Cops: SLA operation targets underage drinking near college campuses

Southampton Town police in conjunction with the New York State Liquor Authority conducted an SLA operation Saturday as part of an initiative to combat underage drinking near college campuses.

Underage agents were used to attempt to purchase alcohol from licensed premises near Suffolk Community College’s Riverhead campus, as well as Stony Brook University and Southampton Campus.

In total, 18 establishments were checked and 16 were found to be in compliance by refusing to sell alcohol to the underage agents without proper identification. Two arrests were made.

Kevin Yanes, 18, of Calverton was arrested at Marta’s Deli in Riverside. Kyle McCarthy, 27, of Flanders was arrested at Hampton Deli in Flanders.

They were both charged with first degree unlawfully dealing with a child, and prohibited sales to a minor, which are both misdemeanors.

“This is a significant increase in compliance compared to an earlier operation conducted by Southampton Town police this summer, when a similar operation found seven premises not in compliance,” a police press release said.

Three co-defendants accept plea deals in Hampton murder case

The three remaining co-defendants charged in the murder of Demitri Hampton pleaded guilty last week to reduced charges and are scheduled to be sentenced Nov. 1, according to online court records.

All three — Corry Wallace, Danielle Hall and Michael Parrish — had faced second-degree murder charges. Instead, they all pleaded guilty to burglary charges in Suffolk County Criminal Court Sept. 26 before Judge John Collins.

Mr. Parrish and Mr. Wallace both pleaded guilty to first-degree burglary, a class B felony carrying a maximum sentence of up to 25 years. Ms. Hall, who prosecutors said drove one of the getaway cars, pleaded guilty to second-degree attempted burglary, a class C felony carrying a sentence of up to 15 years in prison. The murder charge against her was dismissed; it was covered under the plea agreements for Mr. Parrish and Mr. Wallace, according to court records.

A district attorney spokesman did not immediately respond to a request for comment.

Richard Stafford, the attorney representing Mr. Wallace, said his client is expected to receive a sentence of eight years plus five years of post-release supervision. He said he expects Mr. Parrish, who is represented by a different attorney, to receive the same sentence.

“By the time they’re sentenced they’ll do like four years and seven months upstate,” Mr. Stafford said, noting their time already served will count toward the sentence.

Ms. Hall is scheduled to be sentenced to three years with credit for time already served and could be released in March, Mr. Stafford said.

The plea deals come five months after the prosecution’s botched case against Messiah Booker, the Brentwood man who allegedly pulled the trigger, following the revelation during trial that assistant district attorney Glenn Kurtzrock had failed to disclose hundreds of pages of evidence as required. Mr. Booker pleaded guilty in May to second-degree burglary. He was sentenced in June to five years in prison in what Judge Collins said at the time was a “travesty of justice.”

Shortly after Mr. Booker accepted the plea, Mr. Kurtzrock was fired. Janet Albertson, chief of the Suffolk DA homicide bureau, told the judge in the courtroom in May that prosecutors felt they were no longer able to prove the murder charge beyond a reasonable doubt.

Mr. Wallace — a brother to Ms. Hall and Mr. Booker and stepfather of Mr. Parrish — had originally accepted a plea deal to have his murder charge reduced to manslaughter in exchange for testimony he gave at his brother’s trial. He was to be sentenced to 20 years following the original plea deal.

That original plea deal was withdrawn following the violations committed by the district attorney’s office, Mr. Stafford said.

“When you have prosecutorial misconduct, my client couldn’t willingly take any kind of plea,” he said. “We were in negotiation since we became aware of this violation by the prosecutor.”

The second-degree murder charge the defendants faced had carried a possible life sentence.

Mr. Stafford said he believes the evidence withheld would have ultimately made a difference in the case against Mr. Booker and the other defendants.

“No one’s ever seen something like this in Suffolk County before,” said Mr. Stafford, who’s a former prosecutor. “They have some violations here and there … this is something that the scope and depth of it hasn’t been seen.”

Mr. Hampton’s mother, Juanita Trent of Riverhead, told the News-Review last month that she was angered over the way the remaining cases were proceeding.

“They want to plead these people out,” she said at the time. “They want this to go away.”

Local police departments receive grant to combat active shootings

Four days before the mass shooting in Las Vegas that ended with 59 deaths and hundreds of injuries, representatives of law enforcement agencies from across Suffolk County gathered in Riverhead for the public unveiling of new equipment designed to aid officers in an active shooter or terrorist situation.

The Riverhead and Southold police departments have both received grant money through the New York State Division of Criminal Justice Services to purchase equipment like ballistic vests and helmets.

“Confronted by a situation like that [in Las Vegas], it would be very helpful to have this equipment,” said Riverhead Police Chief David Hegermiller. “It gives our officers an edge in situations like that so they can do their job and protect and safeguard the residents and visitors.”

The Riverhead Police Department received $52,425 to purchase protective equipment, including patrol rifles, according to Chief Hegermiller. The equipment has already been ordered and is expected to arrive shortly.

The Suffolk County Police Department received $240,000 that was used to purchase 60 patrol rifles, 156 ballistic vests and 156 helmets. A total of 15 law enforcement agencies in Suffolk County received portions of the $500,000 grant through the Police Protective Equipment Program.

The Southold Police Department received $12,000, according to Chief Martin Flatley. The Shelter Island Police Department received $2,800.

“It’s definitely needed,” Chief Flatley said. “Any kind of training we receive for active shooter drills all revolves around having a heavy ballistic vest and helmet on before going into any situation. We’re trying to equip all of our front line cars with the vest and with the helmet that will be worn by anyone in the car that has to go into a scene like that.”

The department will be purchasing ballistic helmets and vests that are expected within the next month, Chief Flatley said.

“We’re appreciative of the grant. We probably wouldn’t have been able to purchase that without it,” he added. “Anytime we can get equipment like that on a grant it always benefits the department.”

At last Wednesday’s press event at Hotel Indigo in Riverhead, Suffolk Police Commissioner Timothy Sini described the 2016 nightclub attack in Orlando that left 49 people dead. A police officer was wearing a ballistic helmet when he first entered the scene. The helmet was struck by a bullet that would have otherwise have killed him.

“Because of equipment like this, that officer is alive,” Mr. Sini said. “And that is exactly why we have invested in this type of equipment.”

The threat of an active shooter took on even greater meaning Sunday following the devastation in Las Vegas, which has been described as the worst mass shooting in modern U.S. history.

“We are going to do everything in our power to reduce our vulnerability to terror attacks, active shooter scenarios and, God forbid one does occur, we are going to do everything in our power to increase our ability to respond in a way that reduces casualties,” Mr. Sini said during the press conference.

“We’re asking our police officers each and every day to risk their lives and with the threat of global terrorism, particularly with homegrown terrorism, our local police agencies have to step up their game,” he added. “We’re going to ensure that our police officers, who we are asking so much from, are protected.”
